Enforcement Section
The CBRD comprises of the Enforcement Section which is responsible for the monitoring of compliance within the legislations administered by the department whilst at the same time keeping the rate of non-compliance for offences low.
The New Enforcement Section ensures that Adherence to regulatory requirements and assist businesses to improve compliance rate.
Services
(A) Enforcement mechanism which are Compounding and Removal of entities such as Companies, Commercial Partnerships, Foundations and
and Limited Partnerships from register for different types of offences under the relevant Acts.
1.
Compounding
Non-payment of registration fees or non-filing of annual returns/financial summaries/financial statements result in compounding of the offences with the approval of the DPP.
Entities are notified by letters that they should comply with payment of the fees and the filing of appropriate documents.
2. Removal
Where there is no response from non-compliant entities to the compounding notices, the Registrart will start the procedures for removal of these entities
Theses entities are then removed from the register.
(B) Restoration of Companies
The Enforcement Section is also reponsible for restoration of companies:-
• Companies which are removed from the register may apply for restoration
• Upon filing of all required documents and payment of outstanding fees, procedures are initiated to restore the company on the register.
